Facility failed to ensure its abuse policy was implemented related to reporting allegations of abuse and protection from abuse for one (1) of six (6) sampled residents (Resident#1). e facility failed to implement its written abuse policy related to reporting the alleged violation to state agencies and protecting the resident throughout the investigation because SRNA #12 worked, on 11/29/2020 and 11/30/2020, on the same unit where Resident #1 resided.

State Findings:

Based on interview, record review, review of Kentucky Revised Statute (KRS) Chapter 209.030, and review of the facility’s policy, it was determined the facility failed to ensure its abuse policy was implemented related to reporting allegations of abuse and protection from abuse for one (1) of six (6) sampled residents (Resident #1).

On 11/26/2020 at approximately 12:00 PM, State Registered Nurse Aide (SRNA) #4 alleged witnessing SRNA #12 at the Providence Nurses Station being verbally abusive to Resident #1. SRNA #4 escorted Resident #1 to his/her room for safety, and then she reported the alleged verbal abuse to Unit Manager Heritage. However, the facility failed to implement its written abuse policy related to reporting the alleged violation to state agencies and protecting the resident throughout the investigation because SRNA #12 worked, on 11/29/2020 and 11/30/2020, on the same unit where Resident #1 resided. Although the allegation was witnessed by SRNA #4 and reported to Unit Manager Heritage, the manager did not report it to the Center Executive Director (CED). The allegation was not reported to the CED until four (4) days later, on 11/30/2020, by SRNA #4.

Interview with SRNA #4, on 01/26/2021 at 2:03 PM, revealed she was working on the Providence Unit, on 11/26/2020, when she witnessed Resident #1 in his/her wheelchair at the Providence Nurses Station, at approximately 12:00 PM. She stated she heard SRNA #12 call Resident #1 a [OBSCENITY] ing dumbass. She revealed Resident #1 had told SRNA #12 he/she had used the employee restroom and had come to the nurses station to let staff know he/she was done using the restroom. SRNA #4 stated she took Resident #1 back to his/her room, as she was not comfortable leaving Resident #1 at the nurses station. Per interview, she stated she then reported what she witnessed to Unit Manager Heritage. She stated she did not see SRNA #12 the rest of the day. In addition, SRNA #4 stated, when she was working on 11/30/2020, she noticed SRNA #12 working on the same hall as Resident #1, so, at that time, she reported the incident to the Interim Executive Director (IED). She revealed the IED had her report everything that had happened. She revealed staff escorted SRNA #12 out of the facility that day.
